Warranty Italy
Legal warranty for the consumer customer
The consumer customer (hereinafter, "Consumer"), as defined in art. 3 of the Italian Consumer Code (hereinafter, "Consumer Code", Italian Legislative Decree dated 6 September 2005, no. 206), has the right to make use of the legal warranty provided by the Consumer Code itself in articles 128 to 132. Such warranty provides, inter alia, under penalty of forfeiture, for the Consumer to report to the seller any defect of conformity detected by the Consumer in the purchased product within 2 (two) months from discovery (art. 132, Consumer Code), by filling in the appropriate form on the website.
Following this formal communication, the Consumer is entitled to request the repair or replacement of the product, without prejudice to any other right provided for by law in favour of the Consumer. By virtue of the above-mentioned legal warranty, the seller is responsible for conformity defects that occur within 2 (two) years from delivery of the product. Beyond this term, Trevi Spa shall not be liable for conformity defects detected by the Consumer. In case of replacement or repair of the product, the conditions set forth in the warranty for the replaced or repaired product shall be the same as for the original product. Therefore, the overall two-year duration of the legal warranty shall start from the delivery of the original product. In order to benefit from the warranty, the Consumer must submit the purchase invoice. In any case, for the discipline of the legal warranty, reference is made to the provisions of articles 128 et seq. of the Consumer Code.
The legal warranty protects the goods against defects of conformity as regards the sales contract. The customer can find more information on the scope, content and rules for exercising the legal warranty, with examples of cases, by contacting Trevi Spa Customer Service.
In any case, defects caused by carelessness, negligence and failure by the customer to comply with the provisions for the maintenance of products and instructions provided in the user manual delivered to the customer together with the products are not covered.
Legal warranty for the non-consumer customer (Professional Customer)
The Professional Customer, as defined in Article 3 of the Consumer Code, is entitled to make use of the Legal warranty provided for in the Italian Civil Code. This Warranty provides, inter alia, under penalty of forfeiture, for the Professional Customer to report to the Seller any defect of conformity detected in the purchased product within 3 working days from receipt in case of obvious defects, and within 5 (five) working days from discovery in case of hidden defects. The above-mentioned legal warranty applies for a maximum period of 12 (twelve) months from delivery of the product. Beyond this term, Trevi Spa shall not be liable for conformity defects detected by the Professional Customer. In order to benefit from the warranty, the Customer must submit the purchase invoice. Any damage to packages and/or products or the mismatch in the number of packages must be immediately notified, under penalty of forfeiture, by means of a handwritten reservation by the customer on the courier's delivery note.
In any case, defects caused by carelessness, negligence and failure by the customer to comply with the provisions for the maintenance and use of products and instructions provided in the user manual delivered to the customer together with the products are not covered.
