Shipments, exchanges & returns
1. Transport and Shipping
Transport and shipping costs will be calculated and communicated to the user during the order process and before payment.
Please refer to section 2 aforementioned for shipping products to foreign countries.
2. Shipping to Foreign Countries and Customs Duties
For shipments within the European Union to clients that, according to law, can be consider as consumers (not holders of a VAT number), prices will be invoiced including VAT, at the current rate in Italy at the time of Order Confirmation (e.g. 22% in 2020).For shipments within the European Union to customers with a VAT number, indicated in its appropriate field during the purchase process, the invoice will be issued without VAT (provided that the client’s VAT number is registered on the VIES). For non-EU shipments, regardless of the client category (consumer or supplier), the sale is considered as a non-taxable VAT direct exportation, pursuant to Article 8, paragraph 1, subparagraph a) of Italian Presidential Decree no. 633/72. The customer will bear any additional cost of custom clearance at destination.Trevi Spa has no control over these costs and cannot foresee their amount, hence the customer is solely responsible. In any case and for no reason, Trevi Spa will be liable for duties and/or taxes other than those provided for Italian tax and customs duties. Customs policies may vary considerably from a country to another and the client should therefore contact the local customs office for further information.When customers place orders on the website www.emgmobility.it, they are considered as importers and should therefore comply with the laws and regulations in force in the country where they receive the goods. Trevi Spa is expressly exempt from any liability.
3. Product Delivery
Once the purchased products are ready to be shipped and the package is dispatched from the warehouse, the client receives an email with the shipment confirmation. The purchased products will be delivered by courier to the address indicated by the customer.
We will not deliver to P.O. boxes and Poste Restante. Delivery times within Italy are approximately 3-7 working days from receipt of payment and these are not binding for Trevi Spa.
The customer will receive an email with all details about shipment, i.e. the courier’s name, the tracking number and the estimated delivery date. You can follow the shipment on the courier’s website simply by clicking on the tracking number. Upon delivery of the goods, the customer shall carry out all the necessary checks to detect any damage, lacks, defects, other apparent defects or delivered products non-compliant with the order. In particular, the customer shall check the packaging condition, that it is not tampered with or not intact, the number of packages and the product quantity, codes, condition and specifications.
Any damage to the packages and/or products or the mismatch in the package number shall be notified immediately by the customer, subject to forfeiture, in written form on the courier delivery note.
4. Packaging and Handling
Trevi Spa packages the products for the shipment in the most appropriate package and is not liable for any damage, tampering or shortages that may occur after the goods have been dispatched from its warehouses.
The products are packaged according to their use, unless specific requests by the customer, which should be expressly indicated in written form in the purchase order.
5. Right of withdrawal - Conditions to exercise the right of withdrawal, pursuant to Article 52 of the Consumer Code
If the purchaser acts as a private “Consumer”, as defined by Italian Legislative Decree no. 206 dated 6 September 2005 (hereinafter also referred to as “Consumer Code”), pursuant to Article 52 of the Consumer Code, he is entitled to withdraw from the contact signed with the seller without being liable to any penalty and without giving any reason. The period to exercise this right is within 14 (fourteen) days from the date of receipt of the products purchased on www.emgmobility.it.
The Consumer agrees to return the goods without undue delay and in any event not later than 14 (fourteen) days from the date of the withdrawal notification. The Consumer acknowledges that he shall bear the costs of returning the goods and all the costs and risks associated.
Pursuant to Article 59 of Consumer Code, the right of withdrawal shall not be applied:
- when the purchaser is not acting as a private consumer, pursuant to the Consumer Code;
- to products manufactured according to the purchaser’s specifications;
- to customised products that, due to their nature, cannot be returned or are liable to deterioration.
To exercise the right of withdrawal, the purchaser should send a communication relating to its will before the withdrawal expiry period, i.e. 14 days from the delivery date of the goods purchased that he wants to return.
Pursuant to Article 54 of the Consumer Code, in order to express his will to withdraw, the Customer shall
- download and fill in, following the instructions provided herein, the withdrawal form in the user area, within 14 days from the delivery date of the products to be returned.
- As an alternative, the customer may send an explicit declaration of withdrawal from the contract by registered letter to the address here below: Trevi SpA, Strada Statale Consolare RN-RSM 62 47924 Rimini (RN) - Italy
- The Consumer shall print the attached file (or, instead, fill in the pre-printed document that he may have received along with the product) and insert this document in the package containing the product being returned, that will be sent back to the Seller.
- The Consumer shall repack the product, in its intact packaging (or in equivalent packaging), including any instruction manuals and other accessories, as well as the document confirming his exercise of the right of withdrawal.
- Then the Consumer shall arrange - choosing the courier and bearing its associated costs - the shipment and/or its return procedures, and send the package no later than 14 days from the date of the withdrawal notification to the following address: Trevi SpA, Via Raibano 40 47853 Coriano (RN) - Italy
- The Consumer will be liable for any damage resulting from product freight.
Trevi Spa will reject any returns sent to an address other than the one indicated above or for which the Consumer has not bore the shipping costs.
The Customer shall send the goods subject to withdrawal before the expiry of the 14-day period, starting from the date of the withdrawal notification. The deadline will be deemed complied with if the goods are returned before expiry of said deadline.
The product should be returned intact and in perfect condition, in its original packaging or equivalent packaging and equipped with all its accessories, including the instruction manual.
Pursuant to Article 56 paragraph 3 of the Consumer Code, the Seller expressly reserves the right to withhold the refund until the returned product is received or the Consumer has presented evidence of the return, whichever condition occurs first.
Pursuant to Article 56 of the Consumer Code, Trevi Spa will refund the price of the purchased products, excluding the shipping fees bore by the Consumer for the return and any associated damage resulting from product freight.
Failure to comply with the prescribed provisions entitles Trevi Spa to refuse the exercise of the right of withdrawal and the return of the purchased product and to retain the sums paid.
When returning products to Trevi Spa, insuring goods against theft and accidental damage due to shipment is not required. The Purchaser bears the risks related to the return of goods. Therefore, Trevi Spa encourages purchasers who intend to exercise their right to withdraw to insure the shipment - bearing its costs - for the value indicated in the Order Confirmation sent by e-mail.
6. Time and Method of Reimbursement
If all the previous conditions have been fulfilled and the withdrawal has been exercised within the deadline prescribed by law, the Consumer will receive an e-mail confirming acceptance of the return. Pursuant to Article 56, paragraph 2 of the Italian Legislative Decree 206/2005 and subsequent amendments and additions, Trevi Spa will refund the full price of the returned product and shipping costs - excluding any additional shipping fees (e.g.: if the consumer has chosen a different shipment from the least expensive one available on the website) - using the same means of payment as for the initial transaction. The return costs shall in any case be borne by the Consumer.
The refund will be processed within 14 days upon receiving the exercise of the right of withdrawal by the Consumer.
Pursuant to Article 56 paragraph 3 of the Consumer Code, the Seller expressly reserves the right to withhold the refund until the returned product is received or the Consumer has presented evidence of the return, whichever condition occurs first.
The time required to display the refund of the sums paid for the purchased products may vary, depending on the credit institution that issued the card.
Pursuant to Article 57, paragraph 2, of the Consumer Code, the Consumer shall also be liable for any decrease in value of the returned products resulting from use other than what was necessary to ascertain the nature, specifications and operation of these products.
If this is the case, a percentage of between 10 and 90 per cent of the sums paid to the Seller for the purchase of the returned products will be deducted from the refund, as specifically communicated by the Seller by e-mail. If the sums have already been returned to the Consumer, Trevi Spa reserves the right to ask the Purchaser to refund said decrease in value.
